Personally I'm not too worried, and posted for the comedic value - but I do think a fix would do better for the credibility of the situation.

Fixin' Kickin' would be grand.
Whilst fumbling an easy shot (i.e. vs. a mortally-wounded opp) could be possible, it should not happen three times in a row. Once - in a great while!... Twice would require a character with very low Dex AND Int. Thrice would require...a combat system in need of tweaking!
